These Terms of Service (hereinafter referred to as “Terms”) govern the relationship between Guangzhou Hyrun Packaging Co., Ltd. (“Hyrun Packaging”, “we”, “us” or “our”) and you (hereinafter referred to as “you” or “customer”) when you use our products and one-stop customized export services, including purchasing our cosmetic packaging products, cooperating with us on customized packaging solutions, or using our official website https://hyrunpkg.com/.
By using our products or services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our products or services.
1. Scope of Services
We provide the following products and one-stop customized export services to you: R&D, production, supply and international export of makeup and skin care cosmetics packaging, including but not limited to customized PE squeeze tubes, glass bottles, plastic bottles and cosmetic jars (lip gloss tubes, lip balm tubes, essential oil dropper glass bottles, serum glass pump bottles, airless pump bottles, roller ball glass bottles, etc.). We provide full-process support from packaging design to mass production for brand customers. The specific products and customized services shall be subject to the written agreement signed by both parties or the order confirmation issued by us.
2. Order and Payment
- Order Placement
You may place an order with us for customized or bulk cosmetic packaging products through email, phone, or other agreed channels. The order shall include detailed product customization specifications, quantity, packaging requirements, delivery time, delivery address (including international port information), and other necessary information. We will confirm the order with you in writing (including email) within a reasonable time. The order shall take effect after both parties confirm it. - Price
The price of our products and customized services shall be subject to the professional quote provided by us or the price agreed in the order. The quote is based on raw material costs, customization process difficulty and international transportation factors. We reserve the right to adjust the product price due to changes in high-quality environmentally friendly raw material costs, exchange rates, and international logistics costs. If the price needs to be adjusted, we will notify you in advance, and the adjusted price shall take effect only after your confirmation. - Payment
You shall pay the order amount in accordance with the cross-border payment terms agreed in the order (such as advance payment, letter of credit, or installment payment). If you fail to pay on time, we have the right to suspend the production, delivery of products or terminate the order, and you shall bear the corresponding default liability.
3. Delivery and Acceptance
- Delivery
We will deliver the products to the delivery address (or international port) agreed in the order within the agreed delivery time. The delivery method (such as sea freight, air freight for international export) shall be agreed by both parties. The international transportation and customs clearance costs shall be borne by the party specified in the order. We ensure the safe transportation of products in accordance with international trade packaging standards. - Risk Transfer
The risk of damage or loss of the products shall be transferred to you after the products are delivered to the international carrier (for export orders) or delivered to the agreed delivery address (for domestic orders). - Acceptance
You shall inspect the products in accordance with the agreed quality standards within 7 working days after receiving them. If you find that the products do not meet the agreed customization specifications, international quality standards, or quantity, you shall notify us in writing within the inspection period and provide relevant evidence. We will, within a reasonable time, verify and handle it (such as re-customization, replacement, repair, or refund) in accordance with the agreement.
4. Quality Assurance
We select high-quality, environmentally friendly raw materials that meet international standards for production, and strictly control the whole production process. We guarantee that our products meet the national quality standards and the international quality requirements agreed in the order. The quality guarantee period of the products is 3 months from the date of delivery.
During the quality guarantee period, if the products have quality problems (excluding damage caused by improper use, transportation, or storage by you), we will provide after-sales service such as free replacement, re-customization or repair. Our professional technical team will provide timely solutions for quality problems.
5. Obligations of Both Parties
5.1 Our Obligations
- Provide customized cosmetic packaging products that meet the agreed quality and specifications on time, using high-quality environmentally friendly raw materials.
- Provide professional technical support for packaging design, production process and after-sales service for international export.
- Protect your personal information and business secrets (including brand packaging design solutions) in accordance with the Privacy Policy.
- Provide relevant product qualification documents that meet international trade standards as required.
5.2 Your Obligations
- Provide accurate and complete information when placing an order (such as international delivery port, product customization specifications, brand design requirements, etc.).
- Pay the order amount on time in accordance with the cross-border payment agreement.
- Accept the products in accordance with the agreed time and international quality standards, and notify us of any product problems in a timely manner.
- Do not use our products for illegal purposes, and do not infringe on the intellectual property rights of our company or third parties (including our packaging design patents).
- Keep the business secrets provided by us confidential (including customized process, raw material selection, etc.), and do not disclose them to any third party without our consent.
6. Intellectual Property Rights
All intellectual property rights (including but not limited to patents for cosmetic packaging design, trademarks, copyrights, design rights) related to our products, official website https://hyrunpkg.com/, and customized services belong to Hyrun Packaging. Our professional design team’s innovative packaging solutions are protected by intellectual property laws.
You shall not infringe on our intellectual property rights in any way. Without our written permission, you shall not reproduce, modify, distribute, or use our intellectual property rights for any commercial purpose. For customized packaging designs jointly completed with customers, the intellectual property rights shall be agreed by both parties in the written contract.
7. Termination of Services
Either party may terminate the cooperation and these Terms if the other party seriously violates these Terms and fails to correct it within the time limit specified by the notifying party.
In addition, we may terminate the provision of one-stop customized export services to you if you use our products or services for illegal purposes, or if you violate the relevant international trade laws and national regulations.
After the termination of cooperation, both parties shall perform the subsequent settlement obligations in accordance with the agreement.
8. Liability for Default
If either party fails to perform or improperly performs its obligations under these Terms, it shall bear the corresponding default liability. The defaulting party shall compensate the non-defaulting party for the direct economic losses caused by the default (including international logistics costs, raw material losses caused by re-production, etc.).
If the default is caused by force majeure (such as natural disasters, wars, changes in international trade policies, port closures, etc.), the defaulting party shall not bear liability, but shall notify the other party in a timely manner and provide relevant supporting evidence.
9. Dispute Resolution
Any dispute arising from the performance of these Terms (including disputes over customized product quality, international delivery, payment, etc.) shall be resolved through friendly negotiation between both parties based on the principle of international trade fairness. If the negotiation fails, either party may file a lawsuit with the people’s court where Hyrun Packaging is located.
10. Changes to These Terms
We may update these Terms from time to time in accordance with changes in international trade laws, national regulations, and our business operations. The updated Terms will be published on our official website https://hyrunpkg.com/ or notified to you through other appropriate channels. Your continued use of our products or one-stop customized export services after the update shall be deemed as your acceptance of the updated Terms.
